2. Definitions
“We” means seoflower. “You” means the person or business placing an order. A “consumer” is an individual who buys for purposes outside their business or profession. A “service” is anything sold on this website: an audit, a project, a monthly service or a package. A “project” is a one-off service. A “monthly service” is a service billed every month.
3. The services
Each service is described on its page, including what is included, the turnaround and the price. That description is part of the contract. Work not listed is not included, and we will quote it separately if you ask.
4. Ordering and contract
You order by completing checkout. Before you submit, you can check and correct everything you entered. The submit button is labelled “Order with obligation to pay”, and pressing it commits you to pay. The contract is concluded when we confirm your order by email. We may decline an order, for example if our monthly capacity is full or if we cannot access the website the work needs. If we decline, we refund anything you have paid in full.
5. Contract language
A contract can be concluded in Czech or in English. It is concluded in the language of the version of the website in which you completed your order: an order in the Czech version (addresses beginning seoflower.com/cs/) means a contract in Czech, and an order in the English version means a contract in English. We send the order confirmation by email in the same language. The Czech and English versions of these terms have the same content. If they conflict, the version in the language in which the contract was concluded prevails. While we work, we may communicate in Czech or English. Your statutory consumer rights are not affected.
6. Prices and payment
Prices are in Czech crowns (CZK) and exclude VAT. VAT at the statutory rate, currently 21%, is added at checkout. Projects are paid when you order. Monthly services are billed monthly in advance, starting at kick-off. We send invoices electronically. Late payment may lead to statutory interest and suspension of the work.
7. Delivery and turnaround
Services are delivered digitally. Turnaround times on service pages count in working days (Monday to Friday, excluding Czech public holidays) from kick-off, which is the day we have everything we need from you. If you are late with access, information or feedback, the dates move by the same amount.
8. Your responsibilities
You agree to give us accurate information and access in good time, to have the right to give us that access, and to keep your own backups. Unless a service page says otherwise, you or your developers make the changes to your website. We are not responsible for changes made by others.
9. Monthly services and minimum term
Monthly services and packages have a minimum term of three months. After that they continue month to month, and either of us can end them with 30 days’ notice by email. The refund policy sets out what happens to fees.
10. No guarantee of results
Search engines and AI answer tools are run by third parties and change without notice. We do not guarantee rankings, traffic, citations, leads or revenue. We commit to the scope, the deliverables, the turnaround and the reporting stated for each service.
11. Intellectual property
Once you have paid for them, you own the reports, plans, content and other deliverables we create for you. We keep our methods, templates and tools. We will not name you as a client without your written permission.
12. Confidentiality and personal data
We treat your access credentials and business information as confidential and use them only for the work. If we process personal data on your behalf, we will agree a data processing agreement with you on request. How we handle our own data about you is described in the Privacy policy.
13. Liability
Nothing in these terms limits liability that cannot be limited by law, including liability for intentional or grossly negligent harm, or a consumer’s statutory rights. Subject to that, our total liability for a claim relating to a service is limited to the fees you paid for that service, and we are not liable for indirect or lost profit.
14. Cancellation and refunds
Cancellation, refunds and the 14-day right of withdrawal for consumers are set out in the Refund and cancellation policy, which is part of these terms.
15. Complaints
If something is wrong, write to support@seoflower.com and tell us what happened. We confirm receipt and answer within 30 days.
16. Consumer disputes
If we cannot resolve a complaint with you as a consumer, you may take it to the Czech Trade Inspection Authority (Česká obchodní inspekce, Štěpánská 567/15, 120 00 Praha 2, www.coi.cz), which handles out-of-court resolution of consumer disputes. Information is available at adr.coi.cz.
17. Governing law and courts
These terms are governed by Czech law, including the Civil Code (Act No. 89/2012 Coll.). Disputes with business customers are decided by the Czech court with jurisdiction over our address in Ostrava. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.
18. Changes to these terms
We may update these terms. The version in force on the day you order applies to that order.
